FDA Food Safety Modernisation Act

The Food Safety Modernization Act (FSMA) came into effect in 2011 and is the U.S. Food and Drug Administration’s (FDA) first major reform to food safety laws since 1938. The act aims to ensure a safe food supply, focussing on preventative contamination control standards as being a more effective way to improve food safety than reaction and response to catastrophic events.

The law provides the FDA with new authority for enforcements designed to achieve higher rates of compliance, and new tools that hold imported foods to the same standards as domestic ones. So what are the implications for food supply chains looking to export products to the U.S?

Businesses wishing to supply human and animal food products to the U.S will now require adherence to far more stringent regulations, and have the ability to evidence that these goods comply with FSMA safety standards. Large foreign businesses were required to comply with the new regulations by May 2017 with medium and smaller businesses expected to be compliant by March 2019.
